Use of our website is subject to you agreeing to the following Terms and Conditions.
These conditions apply to all online transactions between Manning’s Emporium and any person, firm or company placing an order online for the supply of any goods or services. Manning’s Emporium, by accepting any order for goods from a purchaser, agrees to sell and the purchaser agrees to purchase such goods at the price stated on our website and on the sole basis of the terms and conditions below.
Ordering
When you submit an order on our website, you will receive an order confirmation email confirming that we are have recieved and are processing your order. When you recieve this email you should check the delivery address, e-mail address and phone number you entered for accuracy and let us know immediately if there are any errors. If your order does not arrive to you or to the recipent of an order as a result of inaccurate address information you supplied we will not be liable for replacement or refund.
We use An Post to deliver our orders. This means that by ordering from us you permit postal packets addressed to you to be opened, delayed, detained and/or for the due delivery of the postal packet to you to be interfered with or prevented under the terms and conditions and relevant laws that apply to the An Post service.
We reserve full right, entitlement and title to all goods until such time as payment has been processed.
Processing your orders and secure payment
While we work hard to keep our website up to date and free from errors product description or pricing errors can sometimes occur. If we discover such an error after you have submitted your order, we will contact you prior to completing your order with the correct details. You can then choose to either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat the order as cancelled.
All items for sale on our site are priced in Euros. We accept payment online and use Stripe to process payments. This means you can pay through your Stripe account or by using your credit or debit card. We neither see nor retain any credit card details.
It is possible that we won’t be able to accept your order, or part of it, for any of the following or other reasons:
- Your payment failed.
- We made a pricing or product description error. If this is the case we will contact you to resolve the issue.
- We are out of stock of an item although it was available on the website at the time you ordered. In this case we will contact you to see if you wish to wait until the item is back in stock, substitute a different item, or remove the item from your order.
Delivery and delivery charges
Goods shall be deemed to have been delivered when the person delivering the order obtains receipt of goods confirmation from a person at the delivery address. If your order contains alcohol the person receiving and signing for the delivery must be aged 18 or over. The delivery person may ask to see proof of age.
It is your responsibility to ensure that someone suitable will be available to sign for any order or partial order you send to addresses that are not your own, such as may be the case with gifts.
Where the An Post delivery person cannot find anyone to accept delivery, a card will be left for the recipient with details of how to pick-up from the local An Post depot or to agree an alternative delivery time or location. If you or the recipient to whom you sent the goods fails to make contact within the time specified, the goods will be returned to us and another delivery charge will be made for re-delivery to the original or an alternative address. You will also be charged for any items which have become unsuitable for sale, for example perishable items with a short shelf life.
You can request a specific delivery day but specific times or dates cannot always be guaranteed. Claims for non-delivery must be made within 21 days of order dispatch but the sooner you contact us the sooner we can attempt to resolve this issue.
Expected delivery time is 2-4 working days following the dispatch of your order.
Returns, Refunds, Cancellations & Damages
Our returns policy is in accordance with statutory rights under the EU Consumer Rights Directive. Our refund policy does not affect your legal rights.
Damages
We are dedicated to ensuring all our goods arrive with you in perfect condition. In the rare event of a parcel, or items within a parcel, being damaged when you receive them, please contact us within 48 hours of delivery or sooner if possible. Damaged Goods must be returned to us, suitably packaged, unless we advise otherwise. We will replace or refund the items concerned at our expense and cover resaonable costs of return.
Unwanted Goods & Order Cancellation
In accordance with the EU Distance Selling Directive you have the right to cancel the contract up to seven working days after the date of delivery or to return unwanted goods, subject to certain exceptions. Perishable goods with a short shelf life or goods made to custom specifications may not be returned as unwanted.
Please contact us to let us know you would like to cancel your order. If you cancel before any goods have been dispatched you will be refunded in full. If goods have already been dispatched or delivered you must return the goods to us at your expense. The goods must be unused, in their original unopened and undamaged packaging and suitable for resale.
Unwanted goods can be returned within 7 working days of receipt, as long as the goods are in perfect condition, packaging is undamaged and the items are resaleable. Both the dispatch and return costs will be your responsibility and will only be reimbursed by us in the case of damaged, faulty or incorrectly supplied goods.
Please contact us by telephone, or email us at info@manningsemporium.ie in advance to let us know that you would like to return an item. If a refund is agreed for cancellations or unwanted goods it will be made to the your credit card but will exclude the cost of delivery.
Substitutions
Whilst every effort is made to supply items as specified all goods, and the contents of gift boxes and hampers in particular, are subject to availability. We reserve the right to substitute any items in hampers with similar items, with a guarantee that any replacements will be of equal or greater value. In other cases where goods are unexpectedly not available we will contact you to to see how you wish to proceed and will either replace the items concerned or remove them from the order and refund you their value.
Alcohol
Items containing alcohol can only be ordered and delivered to those 18 years of age and over.
Unforseen Circumstances
We make all reasonable efforts to dispatch goods and have them delivered within the stated time frames. However, we cannot be liable for any loss or damage due to delays or failure to deliver resulting from any cause beyond our reasonable control, such as, but not limited to, compliance with laws or regulations, acts of God, acts or omissions of the purchaser, acts of civil or military authority, judicial action, defaults of sub-contractors or suppliers, labour disputes, failure or delays in transportation, embargoes, wars or riots.

We are committed to ensuring that your privacy is protected. We will only use the information that we collect about you lawfully in full accordance with the GDPR.

Complaints & Disputes
If you have a complaint please let us know us by email to: info@manningsemporium.ie. Any comments you have will be welcomed, taken seriously, treated in strict confidence and dealt with speedily. We will acknowledge your complaint within 48 hours and give you a timescale for resolving your complaint and keep you informed of progress.
In the event of a dispute we will make every effort to come to an acceptable solution for both you and us. If we cannot do so any further action can only be taken under the laws and in the courts of the Republic of Ireland.
